Old Lion Cottage - Booking Terms and Conditions
The terms ‘Party Leader’, 'Your' and 'You' refer to the person booking the property. The terms ’We’, ‘Us’ and ‘Our’ refers to the owners of the property, Richard Bailey and Rosie Bailey.
1. BOOKINGS
a. The person responsible for the booking (the Party Leader) must be at least 18 years old at the time of booking. You must be authorised to make the booking on the basis of these Booking Conditions by all other members of the booking party. By making the booking, you confirm that you are so authorised and that all other party members agree that the booking is subject to these Booking Conditions.
b. Your booking is for the period agreed on the booking confirmation for the purpose of a holiday only and is not intended to create the relationship of landlord and tenant between you and us. You shall not be entitled to a tenancy, or to any assured short hold or assured tenancy or any statutory protection under the Housing Act 1988 or other statutory security of tenure now or upon termination of the agreement.
c. To confirm a booking a deposit equivalent to 25% of the total rental amount is due at the time of booking, except when booking less than 6 weeks before the rental start date in which case the full rental amount will be due at time of booking. Where you have paid a deposit, the balance of payment will be due 6 weeks before your rental start date. If balance of payment is not made by the due date the booking may be deemed to be cancelled and cancellation terms will apply.
d. On receipt of your completed booking form and deposit, we will send you a booking confirmation verifying your holiday details including rental costs and payments made. It is then a firm contract exists between you and us.
e. The number of people staying at the property must not exceed those agreed or detailed on your booking confirmation. You are not permitted to have extra people to stay during the rental period without our permission. You are not permitted to site a caravan or tent anywhere on the premises.
2. SECURITY DEPOSIT
a. A security deposit in the amount £150 must be paid seven days prior to your arrival date and will be returned to you in full within 7 days of your departure unless a claim is made against it. We reserve the right to refuse entry if we are not in receipt of the security deposit, and will not refund the cost of the stay. Any costs for loss or damage caused by your failure to respect the property and its fixtures and fittings will be deducted from your security deposit. Damages and breakages must be reported immediately to us and no repairs of any kind to the property or contents must be attempted by you or your party. We reserve the right to deduct supplementary charges from the security deposit if the property is not vacated at the stated time or in the event of any other breach of this agreement by you.
b. Notwithstanding the security deposit held, you remain liable for the full cost of any repairs or replacements required or other losses incurred by us due to accidental or negligent breakage, loss, damage or other injury to the property and/or the contents therein.
c. Any damage, breakage, or anything giving cause for concern noticed on taking occupancy of the property, must be reported to us within 24 hours of the first day of your stay.
d. Any articles left behind can be forwarded on receipt of a minimum handling fee of £10 plus postage and packaging costs. Any unclaimed articles will be disposed of after 28 days.
e. We reserve the right to evict you and your party without compensation in the case of anti-social behaviour, unreasonable breakages, if smoking restrictions are not observed, if you are causing a fire risk, if the accommodation is being misused, if you behave in a manner that causes a disturbance or a nuisance to neighbouring properties or if there is a breach of these terms and conditions. In such instances no refunds will be provided.
f. We reserve the right to enter the property to inspect it or carry out necessary repairs or maintenance during your stay.
3. ARRIVAL & DEPARTURE TIMES
Arrival times are from 4.00 pm. Please do not arrive early as the cottage will usually be being prepared for your stay and you will not be able to gain access until the designated arrival times.
On the day of your departure you are asked to vacate the property by 10.00 am.
4. STANDARDS & SERVICES
A welcome pack is provided that also contains important information about your stay at the cottage. Please ensure that you read through things carefully and that you familiarise yourself with the accommodation and the location of exits.
b. The cottage will be clean and in good order when you arrive and you must leave it in the same condition in which you found it. If the house is not left clean and tidy, a final cleaning fee of £50 will be charged.
c. The cottage is let fully furnished and equipped. The kitchen has electric cooking facilities, fridge/freezer, sink with hot and cold water, adequate cooking utensils, crockery, cutlery, glasses and other household equipment to a reasonable standard for holiday use and suitable for the maximum number the house is stated to sleep.
d. Whilst we make every effort to maintain the cottage in good condition, we cannot be liable for "force majeure" and events outside our control including but not limited to; storm damage, flood, sudden invasion of pests, failure of public utility services, mechanical breakdown, previous damage by other guests, for which there has not been time to remedy.
e. We make every effort to ensure the standard described and that all the items of equipment described and supplied are in good working order. However, no guarantee is given or liability accepted if any breakdown occurs. If during the holiday any mechanical equipment (e.g. boilers, refrigerators or pumps) break down, you must notify us immediately so we can arrange for repairs or replacement to be made as soon as possible.
f. Wi-Fi Internet is provided as a free of charge courtesy and its provision is subject to availability and the prevailing network conditions. No guarantee is given or liability accepted regarding speeds or the reliability or availability of the service during your stay.
g. Household linen and towels are provided. For stays of longer than one week a change of linen will be provided. Household linen must not be taken out of doors or away from the house.
5. PET POLICY
Dogs will only be accepted with our prior agreement and under the strict understanding that the following terms are agreed by you. At the point of booking your holiday, you are deemed to have confirmed your acceptance of these booking conditions.
a. Dogs must be over 12 months old, fully house-trained and well behaved with no destructive vices. If a puppy or untrained dog is taken to the cottage without our consent this will result in you being asked to leave without compensation.
b. Dogs must be exercised away from the premises. If any soiling occurs in the garden it must be removed immediately. You are responsible for keeping the lawns clear and free of droppings and disposing of them appropriately during and at the end of your stay.
c. Dogs must not to be left unsupervised on the premises as this can result in damage to the property and distress to the dog.
d. Dogs MUST NOT be allowed upstairs in the bedrooms at any time. A stair-gate is provided to prevent access to the upstairs rooms.
e. We ask you not to let your dog on the sofas, but if your dog is a sofa surfer you must bring throws large enough to completely cover and protect our sofas. Please also bring your dog’s bedding and water/food bowls with you.
f. You are responsible for ensuring all traces of your dog are removed from the property prior to your departure; this means pet hairs must be vacuumed & swept up, any paw, nose or tongue "prints" must be cleaned from floors, windows and doors, and the garden must be cleared of any droppings. We don't charge an additional fee for dogs, but if our cleaners have to clear up your dog’s deposits, we will take a cleaning fee from the deposit.
g. Your dog must be flea treated & free from parasites before you occupy the property.
h. Any damage (which must be reported to us immediately), or extra cleaning required (pet hair on the furniture, poo in the garden etc.) following your departure will result in an extra charge. We ask dog owners to be considerate and take responsibility for their dogs so we can continue to welcome dogs at the cottage in the future.
6. CANCELLATIONS & AMENDMENTS
a. If after a confirmed booking is made you wish to amend or change your booking, we will do all that we can to accommodate your request, but it may not always be possible. Any such changes or amendments can only be accepted with our agreement. Any changes made with less than 42 days to the start date of your rental may be treated as a cancellation and new booking and incur cancellation fees.
a. If you cancel your holiday more than 60 days before the start of the holiday you will receive a full refund. Between 30 and 60 days you will receive a 50% refund. Less than 30 days any payments made will be non-refundable. We recommend you take out a holiday insurance that has adequate Cancellation Cover to cover against unforeseen circumstances.
b. We reserve the right to modify or cancel any booking wherever; owing to circumstances beyond our control we cannot put the house at your disposal. In this case we will contact you immediately we become aware of any problem to offer you alternative dates or to cancel the booking with the sole obligation to reimburse the monies we have received.
c. We reserve the right to cancel a booking and retain the deposit if the balance of the rental is not received when it becomes due.
7. NON-AVAILABILITY OF PROPERTY
If for any reason beyond our control the property is unavailable on the day when you are due to arrive (e.g. due to flooding, fire damage etc.) or the property becomes unsuitable for holiday letting, you will receive a full refund of all monies already paid but you shall have no further claim against us.
8. COMPLAINTS
Please inform us of any problems immediately and we will deal with them straight away. If you fail to notify us of any dissatisfaction during your holiday, or abandon the property without our agreement, we cannot accept liability for any complaints in retrospect.
9. LIABILITY
We have no liability to you for the death or personal injury to you or any member of your party. We are not responsible for any loss, damage or theft to your personal property during your stay. We will not issue refunds if heavy snowfall or other extreme weather means you are unable to travel. We recommend you take out a holiday insurance that covers the Independent Traveller and has adequate Personal Travel, Personal Injury and Cancellation Cover. Should you need to cancel your holiday at any time it may be possible to claim any cancellation charges back from your policy.
10. ACCEPTANCE OF BOOKING CONDITIONS
When you complete a booking through our website, by telephone or email and have paid a deposit and had your booking confirmed to you in writing, you will be deemed to have accepted these terms and conditions without exception or reservation. Your statutory rights are not affected.
